Kenya: Judges Rule Kadhi Courts Illegal

NAIROBI – A national debate has ensued after judges, sitting as an interim Constitutional Court, ruled on May 24 that the inclusion of Kadhi Islamic courts in the current law is unconstitutional, given that such state support would favor one religion over others, the Daily Nation reported on May 24.  The judges did however reserve judgment as to whether or not the provision should be included in the proposed constitution, which will be subjected to a referendum on August 4, 2010.
